At Cou Cou, we care about your privacy. That’s why we only collect personal data if we have a good reason to do so. That’s also why we want to communicate transparently what we do with your data.

This Privacy Policy explains the types of information we may collect from you or that you may provide when using our Services. This Privacy Policy also describes Cou Cou’s practices for collecting, using, maintaining and processing information. 

For the purposes of European Economic Area data protection law (the “Data Protection Law“), the data controller of the data processed through the Services is the Customer who makes available and grants access and use of the Services to anyone on its behalf. For data retained through the website or data processed not through the Services [(i.e. contact details of potential customers or resumes sent to us from potential employees for the purpose of engagement with Cou Cou Intimates)], we are the controller (the “Controller”).

 

WHO ARE WE?

Cou Cou is an intimate essentials brand, aiming to bridge the gap between daily underwear and lingerie, while reducing the impact of our most disposed of garments.

For ease of reference, we will further refer to ourselves using “we'', “us”, “our” or “Cou Cou Intimates ”. “You”, “your” or “yours” means the organisation/individual using the Services

WHICH PERSONAL DATA DO WE COLLECT AND WHY?

Below you can find what type of personal data we collect, what we use it for and how long we will keep it: 

  1. Your first and last name and your address
    We cannot be sure to address you correctly if we don’t know who you are, and if you are purchasing an order from us we will need to know where to deliver this order to. We will keep this information in our customer database for as long as you do not object to us keeping it. You can always let us know if you no longer want us to keep this information and we will delete it immediately.

  2. Phone number and email address
    This is so we can easily contact you. In principle, we will never contact you unless it is to answer a question, let you know important information about your order, if we are working on an assignment for you or if you have applied for a job with us.

    If you signed up to our newsletter, we may also send you updates on what Cou Cou is up to. We do not want to spam you and we understand if you would rather not receive newsletters. If that is the case, you can always let us know, or you can unsubscribe from our mailing list using the link you can find at the bottom of each newsletter.

    We will keep your email address and phone number in our customer or candidate database for as long as you do not object to us keeping it. If you no longer want us to keep this information, you can also always let us know.

    Please do note that for as long as we have an ongoing contract, we are not able to remove this information from our databases as we will need it to execute the contract. And even after our contract has ended, we may be under a legal obligation to hold on to some of this information for a bit longer. For example, under accounting legislation, we must keep copies of our invoices which may mention your email address.

  3. IP-address, Preferences & Data
    When you visit our Site or get in touch with us, we may collect, generate, store and use certain personal data about you. In some cases we will use cookies to do this, for further information about the cookies we use and how to opt out of such cookies please see the section on Cookies.

    This personal data may include:
    -technical information, including: the Internet protocol (IP) address used to connect your computer to the Internet; your login information (if accessing an account with us); browser type and version; time zone setting; browser plug-in types and versions; device types; operating system; time and date of consent and platform; and any phone number used to call our customer service number.

    -information about your visit to our Site, including: the full Uniform Resource Locators (URL); clickstream to, through and from our Site (including date and time); products you viewed, searched for or purchased; page response times; download errors; length of visits to certain pages; page interaction information (such as scrolling, clicks, and mouse-overs); and methods used to browse our Site.

    We collect this data to help improve our site and your experience with Cou Cou. This information is stored on our customer database and Google Analytics . If you no longer want us to keep this information, you can also always let us know.

  4. Information provided during job applications
    If you apply for a position with us, you will provide us with personal data in your cover letter and your CV.

    We will save your contact details, cover letter and CV of every job applicant in our candidate database and may contact you in the future regarding job openings that may be of interest to you. Of course, we will delete all this information from our candidate database if you don’t like us holding on to it. Just let us know at hi@coucouintimates.com if this is the case. 

  5. Payment Information
    All payments made on our website are possessed by a third party. We do not collect or store your card details or sensitive payment information. We do however collect your billing address to populate the invoice for your order.

    These third parties have undertaken sufficient precautions to prevent the loss of your data. Some of these external data processors may be based in the United States and have certified their compliance with the EU-US Privacy Shield Framework, which means they will respect comparable data protection standards as those that apply in Europe.

    We will keep your billing address for as long as you do not object to us keeping it. If you no longer want us to keep this information, you can also always let us know. It is important to note that we may be under a legal obligation to hold on to some of this information for a bit longer. For example, under accounting legislation, we must keep copies of our invoices which may mention your billing address.
     
  6. Children’s Data
    Our website is not intended to be used by children, and we do not knowingly collect any personal information about children. We are really careful to ensure all your information is kept private. 

We work hard to protect your personal data against unauthorised access or disclosure. Some of these external data processors may be based in the United States and have certified their compliance with the EU-US Privacy Shield Framework, which means they will respect comparable data protection standards as those that apply in Europe. 

You should know that in the following exceptional circumstances, your data could also be shared with others:

  • If we are under a legal obligation to share data with the authorities or if we have to share data to comply with an enforceable government request, we don’t have much of a choice and we will share the data the authorities ask for, which may include yours.
  • If another company decides to buy the shares of our company or decides to buy Cou Cou Intimates from us, we will of course have to transfer your data to that company. That company will then take over all obligations under this Privacy Policy.

INTRODUCTION

Cou Cou Intimates is a female-founded and purpose-driven brand. We’re redefining the narrative of our intimates for the new generation of women by bridging the gap between our lingerie and daily underwear ~ a new category of “intimate essentials”. 

Through paving an entirely new category of “intimate essentials”, omnichannel distribution strategy and purpose, community-driven brand ~ Cou Cou aims to become the Intimates Essentials legacy brand of our generation. 

Marketing plays a significant role in how we attract and win business, and we acknowledge that there are ethical approaches we can take as a company to ensure that we can live by our ‘triple-bottom’ line approach in business.

Treating our customers with respect and focusing on long-term growth – we can build strong relationships with our community through a set of shared values to realise our vision of reducing the environmental impact of our most disposed-of garment and celebrate our female, embodied experience, every day.

We founded Cou Cou to reduce the impact of our intimates. To take responsibility for the whole life cycle of our undies, we make our cou cous from 100% GOTS Certified Organic Cotton, a sustainably-sourced fabric that’s also completely compostable. By designing for longevity, promoting conscious consumption, and operating through transparency, we hope to make our most disposed-of garments a little less disposable. PURPOSE

Cou Cou Intimates seeks to uphold the highest ethics when it comes to our marketing, which includes radical transparency, conscious consumption, intention, taking feedback and inclusivity.  

Below highlights our approach to our ethical marketing, practices and efforts to go beyond compliance to ensure honesty, radical transparency, conscious consumption and  intention, in our ways of working.


SCOPE

This Policy applies to all employees and third parties associated with Cou Cou Intimates or any of our subsidiaries or their employees including creative, digital and public relationships agencies, no matter where they are located.  

In the context of this Policy, third-party refers to any individual or organisation that Cou Cou Intimates meets and works with including but not limited to suppliers, contractors, distributors agents and customers. 

 

MARKETING PRINCIPLES/COMMITMENTS

I. Legally Complaint
All marketing communication must comply with independent marketing and advertising standards in our local jurisdiction and the fashion industry within the jurisdictions we market in, as well as being decent, honest and truthful. To ensure this happens, we prepare all marketing communication with a sense of responsibility to consumers and society.

We must also respect the privacy and confidentiality of customers, protecting them from unwarranted infringements of privacy. To learn more about this - review our Privacy Policy.

II. Honesty
We commit to absolute honesty in our marketing in our own campaigns/for customers and partner-driven projects.

To do this, we pledge to:

  • Never use dishonest marketing tactics for our own or client marketing campaigns, including:
  • False advertising: exaggerating values and benefits of our offering
  • Fake or overly doctored reviews and testimonials
  • Inflated analytics or results when creating messaging 
  • Never “cherry-pick” specific data points to use in marketing and communications that are not representative overall marketing impact

  • Makes transparent potential risks and negative impacts of our offering, including, when appropriate fibre and material origin, processing and production as well as final garment composition.
  • Evidence everything we publicly state to prove any claims that our customers are likely to regard as objective and that are capable of objective substantiation
  • Maintain best practice with white hat SEO and content marketing, avoiding any ‘black hat’ tactics
  • Reject Impact Washing in all its forms - this is similar to greenwashing and happens when a business exaggerates its positive impact to gain a marketing advantage or uses “feel good” marketing to cover up or distract from negative outcomes that their core business model is having in other areas–socially or environmentally.

III. Environmental
Both in the messaging and in the ways in which we advertise we commit to minimising the impact we have on the environment.To do this, we pledge to:

  • Be truthful and honest in our communication when it comes to the impact our offering has on the environment, to avoid any issues related to greenwashing - taking into account governmental guidance including the Green Claims Code published by DEFRA
  • Where possible, measure the emissions related to our advertising
  • Choose communication methods and partners that align with our focus to have a reduced impact on the environment
  • Not make unqualified claims and any absolute claims must be supported by a high level of academic and scientific evidence. 
  • Base environmental claims on the full life cycle of an advertised product, unless the marketing communication specifically states otherwise, and make clear any limitations. 
  • When using the natural environment in our advertising, we will do so in a relevant

We commit to socially responsible communication and marketing in our own campaigns/for customers and partner-driven projects.

To do this, we pledge to focus on the following areas:

  • Inclusivity: We recognise that the "average consumer" may not represent everyone, and we strive to consider diverse perspectives in our advertising decisions.
  • Vulnerable Groups: We acknowledge and prioritise the needs of vulnerable groups, ensuring that our marketing is understood and positively received by society as a whole.
  • Human Dignity: We respect the inherent dignity of all stakeholders, valuing their individual differences and avoiding negative stereotypes or dehumanising portrayals.
  • Customer Satisfaction: We listen to our customers, continuously improving their satisfaction by monitoring their needs and making reasonable efforts to meet them.

V. Using advertising as a force for good 
We see advertising as an incredibly powerful tool and have set up programs and partnerships with 1% for the Planet and GOTS to promote our environmental commitment through our marketing. Intimates with an Impact: Cou Cou is bringing sustainability to your top drawer.     

Cou Cou Intimates is bringing attention to our most-disposed garment. Our undies are our most intimate items; we wear them daily and wash them often. But because of this, our undies are also our most disposed-of garments and, very likely, the only ones you won’t be reselling on Depop. Not to mention that, currently, only 2% of underwear is sustainably-sourced. This all means that your standard multipack undies end up spending more time in a landfill than in your top drawer. We founded Cou Cou to reduce the impact of our intimates. To take responsibility for the whole life cycle of our undies, we make our Cou Cou’s from 100% GOTS Certified Organic Cotton, a sustainably-sourced fabric that’s also completely compostable. By designing for longevity, promoting conscious consumption, and operating through transparency, we hope to make our most disposed-of garments a little less disposable.

GOTS CERTIFIED ORGANIC COTTON

The worldwide leading textile processing standard for organic fibres, including ecological and social criteria ~ from the harvesting of the raw materials, environmentally and socially responsible production along the whole supply chain. The GOTS strict standard ensures that workers’ rights are protected, working conditions are safe, only low impact dyes and inks are used, wastewater is treated properly, and energy and water use is monitored properly. The cotton that Cou Cou uses is grown in the Aegean Region of Turkey, and this fiber is considered one of top 3 sustainable cotton fibers in the world., and it’s fully compostable too. 

1% for the Planet - contributing at least one percent of our annual revenue to environmental causes to protect the environment.

RESPONSIBILITIES

The marketing team, led by the Brand & Marketing Director are ultimately responsible and accountable for ensuring compliance with this Policy. This compliance extends to any third parties/marketing partners - who will be notified of the existence of this policy 

Cou Cou Intimates will not work with any partner unwilling to comply with this Policy.

TRAINING

It is easy to claim that our efforts are honest, however, it takes discipline, rigour, and sometimes internal conflict to ensure honesty in marketing. To ensure this happens our marketing team is trained up and accountable to our Ethical Marketing Guidelines, with refreshers run annually and when new marketing employees joining to ensure best practice is maintained.

Throughout the guidelines, we ask ourselves the following questions during campaign strategy and execution:

  • Are we clearly communicating our [offering’s] value without exaggerating or misleading our key audiences?
  • Are we using language that honestly communicates the features and benefits of our products and services?
  • Are we accurately quoting our customers, partners, and team when we share reviews or testimonials?
  • Is our use of data and examples honest and accurate when promoting our features, benefits, or the impact of our products and services?
  • Is there internal pressure to communicate dishonest information within the marketing and communications coming from team members or the leadership? If so, we will push back or disengage from the project. A reminder the company’s whistleblower policy is here if you wish to raise concerns anonymously. 
PUBLICLY DISCLOSING

Cou Cou Intimates will disclose in our annual impact report, any marketing campaigns that in retrospect didn’t meet our ethical standards. We do this as we acknowledge that we are improving in this space, but there is still much for us to learn.

With the disclosure, we will also share our learnings and future corrections to not only ensure we are able to fulfil our ethical marketing policy in the future, but also share this with other companies who can utilise these learnings also.

HUMAN RIGHTS POLICY

This policy’s purpose

Cou Cou is fully committed to human rights in the workplace. Our commitment includes respecting the dignity and worth of all employees, as we want to encourage everyone to reach their full potential with us and look forward to the work they do.

As part of this promise, we are a committed equal employer who recruits, hires, trains, promotes, compensates and administers all personnel actions without regard to any legally protected status. We are committed to protecting the human rights of all our colleagues and of everyone who receives direct or indirect services from us. As a responsible and ethical organisation, we fully support the principles of the Human Rights Act and all associated legislation.

This policy has been considered against the Modern Slavery Act, the International Bill of Human Rights and the ILO Declaration on Fundamental Principles and Rights at Work.

This Human Rights Policy applies to all Cou Cou staff. We also expect our suppliers and agencies to respect and adhere to this policy, which is addressed in our Supplier Code of Conduct.

This policy sits alongside our Employee Handbook, Health and Safety Policy, Supplier Code of Conduct and Supplier Contracts.

 

The policy

As a business, our Human Rights Policy commits to the following:

  • Child Labour: Cou Cou do not use child labour and we comply with all relevant laws in this regard. We do, however, support legitimate workplace apprenticeships, internships and other similar programmes that comply with the applicable laws and regulations.

  • Modern slavery: At Cou Cou we do not make use of any forced labour or debt-bondage labour in accordance with the Modern Slavery Act. We have a zero-tolerance approach towards human trafficking.

  • Health, Safety and Hygiene: All Cou Cou employees work in an environment that is both safe and healthy, in line with our Health and Safety Policy. We are always working to improve the environment our employees work in, both at home and in the office.

  • Discipline: Cou Cou prohibits absolutely any form of physical abuse or discipline, the threat of physical abuse, sexual or other harassment and verbal abuse or other forms of intimidation. Disciplinary and grievance procedures are clearly documented and communicated to all employees in our Employee Handbook, under “Grievance Process”. As per the process, all disciplinary measures of a serious nature are recorded and actioned.

  • Working Hours: Cou Cou Intimates ensure that working hours comply with the law and industry standards. As per our flexibility policies in our employee handbook, we do everything we can to give you the flexibility you need for work-life balance.

  • Equality of Treatment: Cou Cou is fully committed to eliminating discrimination in recruitment, training and working conditions, on grounds of race, colour, sex, age, religion, political opinion, national extraction, sexual orientation, disability or social origin and to promoting equality of opportunity and treatment as outlined in the Employment Handbook. As per every Employee Job Posting of ours, we welcome anyone and everyone to our business.

  • Employment terms: Cou Cou Intimates provides written and clear contracts which detail the terms and conditions of its staff employment. We ensure that work performed by employees is always on the basis of recognised employment law and practice.

  • Remuneration: Cou Cou Intimates always provide wages and benefits that meet national standards. We are an accredited Living Wage employer, which also extends to any outsourced services and third-party contractors we may use. We provide employees with clear written information on their pay and working conditions. As a business, we prohibit deductions on employees’ wages as a disciplinary measure, and we are committed to equal pay and benefits for all genders for work of equal value.

MESSAGING TERMS OF SERVICE

The Cou Cou Intimates mobile message service (the "Service") is operated by Cou Cou Intimates (“Cou Cou Intimates”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Cou Cou Intimates’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Cou Cou Intimates through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, product launches, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Cou Cou Intimates. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18883759223 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Cou Cou Intimates mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

MESSAGING PRIVACY POLICY
PROGRAM DESCRIPTION

The Messaging Privacy Policy explains how Cou Cou collects and uses information about you in relation to its text message marketing program. We use Klaviyo to provide the messaging service to you. Klaviyo acts as our service provider. Klaviyo and Shopify act as our data processor of your information.

COLLECTED INFORMATION

We collect various information on our behalf from and about you, including information you directly provide when you use the Messaging Service. For example, we collect the phone number and email address you provided when signing up for the Messaging Service. When you send messages via the Messaging Service, we will also collect your messaging history and any information included in those messages.

If you contact us with question about the Messaging service or for customer service reasons, we will also collect your contact information.

USE OF INFORMATION

We use your information to deliver, analyze, and support the Messaging Service. We may also use your information to enhance the Messaging Service features and customize and personalize your experiences on the Messaging Service.

WHO WE SHARE YOUR INFORMATION WITH

We will not share your opt-in to an SMS campaign with any third party for purposes unrelated to providing you with the services of that campaign. We may share your Personal Data, including your SMS opt-in or consent status, with third parties that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages.

PROTECTION OF INFORMATION

We take organizational, administrative and technical measures to protect your personal data against unauthorised access or disclosure. While we work hard to do so, online activity cannot be 100% secure. We cannot accept liability for unintentional disclosure.

RETENTION OF INFORMATION

We retain your information for as long as you participate in the Messaging Service or as needed to comply with legal obligations. 

TIME OF DAY RESTRICTIONS

The TCPA prohibits any telephone solicitation anytime before 8am and after 9pm in the recipient’s time zone. We abide by quiet hours and will only send messages between 9am to 8pm in the recipient's time zone. 

CONSENT

Consent to receive automated marketing text messages is not a condition of any purchase. You can opt-out of receiving further commercial text messages via the Messaging Service by responding to any of our text messages with any of the following reply: STOP.
